By accessing, browsing, registering an account on, or purchasing from the Shukify platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Shukify platform.

2. ACCOUNT REGISTRATION AND ELIGIBILITY

2.1 Customer Eligibility

By using Shukify, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction
• You have the legal capacity to enter into binding contracts
• You are not prohibited from purchasing goods or services in the United States
• You have not been previously banned or terminated from Shukify or similar platforms
• All information you provide is accurate, complete, and current

3. PURCHASING AND ORDERS

Shipping methods and estimated delivery times are displayed during checkout. Delivery timeframes are estimates only and are not guaranteed. Shukify is not responsible for delays caused by shipping carriers, weather, or other unforeseen circumstances.

6.2 Delivery Address

You are responsible for providing an accurate and complete delivery address. Shukify and vendors are not responsible for packages delivered to an incorrect address provided by you.

6.3 Risk of Loss

Risk of loss for products transfers to you upon delivery to your address or upon your pickup of the product, whichever occurs first. You are responsible for inspecting products upon delivery and reporting any damage or discrepancies within a reasonable time frame.

6.4 Lost or Damaged Shipments

Vendors are responsible for any warranties associated with their products. Product warranties, if any, are provided by the vendor, not by Shukify. For warranty claims, contact the vendor directly.

8.2 Limited Warranty Disclaimer

SHUKIFY PROVIDES THE PLATFORM ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. SHUKIFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.3 Third-Party Products

All products sold through Shukify are provided by third-party vendors. Shukify does not manufacture, inspect, or test products before they are delivered to you. You purchase products at your own risk.

8.4 Product Safety

Vendors warrant that all products comply with applicable safety regulations and laws. If you believe a product is unsafe or poses a health risk, contact the vendor and Shukify customer support immediately.

9. CUSTOMER CONDUCT AND PROHIBITED ACTIVITIES

9.1 Prohibited Conduct

You agree not to:

• Engage in fraudulent, deceptive, or unlawful activities
• Use the platform to harass, threaten, or abuse vendors or other customers
• Post false, defamatory, or offensive content in reviews or comments
• Manipulate reviews or ratings through fake accounts or payment incentives
• Attempt to bypass payment systems or access restricted areas of the platform
• Use automated bots or scraping tools to access the platform
• Disrupt or interfere with platform functionality
• Engage in price fixing or collusion with other customers
• Post content that violates intellectual property rights
• Post content that promotes violence, discrimination, or illegal activities
• Post content that doesn't adhere to our standards of tznius (Jewish laws of modesty)
• Misrepresent your identity or credentials

9.2 Enforcement

Shukify reserves the right to investigate suspected violations and take action including:

• Warning or suspension of your account
• Cancellation of orders
• Forfeiture of refunds or credits
• Permanent termination of your account
• Cooperation with law enforcement

10. CUSTOMER REVIEWS AND RATINGS

10.1 Review Posting

Customers may post reviews and ratings for products and vendors on Shukify. You understand that:

• Reviews represent your personal opinion
• Shukify does not endorse or guarantee the accuracy of any review
• You are solely responsible for the content of your review
• Reviews must be truthful, accurate, and based on your actual experience

10.2 Prohibited Review Content

You agree not to post reviews that:

• Are false, misleading, or unsubstantiated
• Contain profanity, hate speech, or offensive language
• Disclose personal or sensitive information about anyone
• Promote other businesses or products

• Are posted by competitors to harm vendors
• Violate third-party intellectual property rights

10.3 Review Removal

Shukify may remove reviews that violate these Terms or appear to be false or malicious. Vendors may report reviews they believe are inaccurate or in violation of these Terms.

10.4 Review Authenticity

You agree not to:

• Post fake or fraudulent reviews
• Pay for positive reviews or removal of negative reviews
• Solicit reviews from friends, family, or other sources in exchange for incentives
• Create multiple accounts to post duplicate reviews

11. DISPUTE RESOLUTION

11.1 Direct Resolution

If you have a dispute with a vendor regarding an order or product, you are encouraged to contact the vendor directly to attempt to resolve the matter.

11.2 Shukify Mediation

If direct resolution is not possible, you may request mediation through Shukify's dispute resolution system. Shukify may, at its discretion:

• Mediate the dispute
• Request evidence and documentation from both parties
• Make determinations based on the facts and these Terms
• Require refunds or other remedies

11.3 Arbitration and Legal Resolution

If a dispute cannot be resolved through mediation, either party may pursue legal remedies through:

• Binding arbitration in accordance with the American Arbitration Association (AAA) rules
• Traditional civil litigation in courts of competent jurisdiction
• Alternative dispute resolution through the Bais Din system (Jewish religious arbitration) if both parties agree

Any legal proceedings will be conducted in accordance with applicable U.S. law, and if Jewish, Halacha.

11.4 Escalation to Shukify

You may escalate disputes to Shukify if you believe a vendor has engaged in fraudulent or deceptive practices or violated these Terms. Shukify will investigate such complaints and may take action against vendors.

12. LIABILITY AND LIMITATION OF DAMAGES

12.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHUKIFY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Business interruption or loss of use
• Any damages arising from products purchased through the platform
• Any disputes between customers and vendors
• Unauthorized access to your account or personal information
• Errors or omissions in product descriptions or pricing

12.2 Liability Cap

Shukify's total liability to you, arising from or related to these Terms or your use of the platform, shall not exceed the total amount paid by you to Shukify in the 12 months preceding your claim or $100, whichever is less.

12.3 Assumption of Risk

You acknowledge that:

• Using the platform involves inherent risks
• You assume all risks associated with purchasing through Shukify
• Shukify is not responsible for vendor conduct or product quality
• Shukify is not responsible for lost, damaged, or delayed shipments

12.4 No Warranties

SHUKIFY DOES NOT WARRANT THAT:

• The platform will be available at all times or error-free
• Defects will be corrected
• The platform or server are free from viruses or malware
• Any information is accurate, complete, or timely

13. INDEMNIFICATION

13.1 Indemnification by Customer

You agree to indemnify, defend, and hold harmless Shukify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of applicable laws or regulations
• Your use of the platform
• Your purchase or use of products
• Disputes with vendors or other customers
• Your breach of representations or warranties

14. DATA PRIVACY AND SECURITY

14.1 Data Collection

By posting reviews, comments, or other content on Shukify, you grant Shukify a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content on the platform.

15.4 Copyright and Trademark

Shukify respects intellectual property rights. If you believe content on Shukify infringes your copyrights or trademarks, contact Shukify immediately with evidence of your rights.

16. ACCOUNT SUSPENSION AND TERMINATION

• You engage in fraudulent or suspicious activity
• You fail to pay for orders or dispute legitimate charges

You may not assign or transfer your rights or obligations under these Terms without written consent from Shukify. Shukify may assign these Terms to a successor or affiliate.

These Terms are for the benefit of you and Shukify only. No third party has any rights under these Terms.
